Supreme Court Zambia Gives Decision On Portland Cement Ownership

Dr. Rajan Mahtani is certainly a happy man now. The Supreme Court Zambia as of late gave its ultimate conclusion on the case by the Ventriglia family. In this decision, the claim by the Ventriglia family was viably dismissed in the wake of investigating confirmations and thinking about all conditions. The truth behind this case dates long back when the Zambezi Portland Cement production line went through share rebuilding and greater part shares were given to Dr. Mahtani owned Finsbury Investments by means of a unique shareholding. Nonetheless, this unique shareholding understanding was questioned, which eventually brought about the issue being hauled to the Lusaka High Court. The Lusaka High Court took over 10 years to report its judgment and regardless of having all confirmations and tributes, equity Nkonde gave a dubious choice where the Ventriglias were declared as just investors of the Portland Cement industrial facility. Dr. Rajan Mahtani then, at that point tested this choice at the higher Court of Appeal. The adjudicator at the higher Court of Appeal was equity Mwinde who gave an official conclusion on 31st January 2019. As per this choice, Dr. Rajan Mahtani claimed Finsbury Investments is greater part investor and lawful proprietor of the production line.

After this higher Court of Appeal’s decision was questioned, a bench of three SC judges was established for evaluation. Upon investigation, the Supreme Court bench came to the conclusion that the claim was invalid due to non-compliance of the claim registration rule in which claims are to be submitted within 14 days of the court decision. As a result, the claim by the Ventriglia family was rejected.
