Lusaka High Court’s Decision On Portland Cement Zambia Unjustified
The case of
Portland Cement Zambia is known to all. The factory is presently
contested for its legal claims, and one of the contestants is Dr.
Rajan Lekhraj Mahtani. Dr. Mahtani is one of the top known and highly
respected businessmen in Zambia. He has more than thirty years of
successful business experience which includes establishment of top
companies in Zambia such as Mahtani Group of Companies, Finsbury
Investments and Finance Bank Zambia. Apart from this, Dr. Mahtani is
also known for his charitable and philanthropic activities. He has
contributed to numerous charitable activities and organisations such
as social and environmental NGOs. Despite these activities and his
transparent and ethical business practices, he is often the target of
conspiracies and jealous people.
There is no doubt
that the present Zambian law and government is challenged with issues
such as corruption and bureaucracy. This has not only reduced the
economic growth and viability of the nation, but also creates
challenges for organisations that are not able to function properly
due to long-pending cases. The case of Portland Cement Zambia is a
prime example wherein the factory’s fate hangs in balance due to
the long running trial. The case has been going on for almost ten
years and during this time, the productivity and overall revenue
generation capacity of the factory has reduced significantly. Many of
the experts have even warned that if the factory is not given to its
real owner soon, it might be too late to revive the factory to its
original glory.
The latest announcement made by the Lusaka High Court judge does not go with the
expert’s opinion. While final judgment was given against Dr.
Mahtani’s claims, a new appeal has been made by Dr. Mahtani at the
High Court of Zambia.
